5 Tips for Winning Your Divorce Case

Sep 20, 2022

While divorce is not anybody's wish, bad things, like abusive partners, lead some couples to divorce. If both parties agree on serious issues like property division and child custody, divorce is easier than cases where the partners cannot negotiate.

If out-of-court settlement efforts have failed, expect a challenging divorce case in court. Therefore, you should look for ways to protect your interests throughout the litigation process.

Read on to discover some tips for ensuring the best outcome for your divorce case.

1. Hire an Experienced Divorce Attorney

Due to the legal matters of a divorce case, you need a legal professional to guide you through the process. An experienced divorce attorney uses their skills to protect your interests in serious issues like property division and child custody.

An attorney also helps make critical decisions about your divorce by providing the necessary information. For example, depending on the nature of your case, an attorney can help you choose between agreeing to your spouse's demands during negotiations and proceeding to litigation.

2. Keep a List of Your Assets

If your spouse is unwilling to share their assets after a divorce, they can use numerous tricks to have the biggest share. For example, one can hide assets or change ownership. Therefore, use all means possible to protect your assets before and after filing for divorce.

You can start with creating a list of everything you own, individually or jointly, and then look for all the documents proving ownership of personal property. In the case of retirement and joint bank accounts, check who can access them and the balances.

While it might be tempting to withdraw cash from your joint account or to sell or change ownership details for your property, never try such tricks, as they could lead to more troubles.

3. Don't Leave Your Matrimonial Home

Leaving your matrimonial home does not affect your rights to the property's ownership, but it can disadvantage you in numerous ways.

For example, if you leave your matrimonial home voluntarily, a court may consider your actions as abandonment, thus negatively impacting child custody arrangements (depending on your state of residence).

Moreover, when you move out of your matrimonial home, you minimize the chances of reaching an agreement with your spouse due to the limited negotiation opportunities. Therefore, despite your decision to end your marriage, never leave your matrimonial home if you want to live there after the divorce.

4. Avoid Altercations With Your Spouse

Though you might continue living in the same house until the court makes its decision, desist from any actions your partner might use against you in court. To be on the same side, assume that your partner records all your conversations to use them against you in court and ask yourself if you would want the information out in public.

Avoid abusive verbal language or written messages through text, email, or social media. Also, avoid discussing your divorce case with friends and family, as it could end up in court.

5. Don't Let Your Emotions Impact Your Decisions

While divorce is painful and emotional, you should keep your emotions in check to avoid decisions that jeopardize your case and affect your and your family's future. Let your divorce attorney guide you through the process as they understand your situation and are more experience in dealing with cases like yours.

Due to the complexities of divorce cases, you must prepare well to protect your interests successfully. Use the tips above to ensure success in serious divorce issues like property division and child custody.
