Increase Your Chances of Winning Child Custody Case with These Tips

Sep 19, 2022

Divorce or separation can debilitate you emotionally, physically, and mentally. And things only get harder when you have kids involved in the equation.

As a parent, you want the best for your children. And although you may feel that you are the right custodial parent, the court doesn't always see things that way. So you may have to fight for custody of your children and prove to the court that you are capable and deserve to have custody of them.

While there is no assurance that you will win your custody case, there are things that you can do to improve your chances. Here are some tips on how to win child custody.

Put Your Kids' Interest First

As badly as you want to win custody, don't focus so much on the case that you forget what's important - your children. Remember that the child custody case is not a chance to fight your ex and show that you are better than them. The case is not a time for payback for the pain that your ex may have caused you. Instead, all your decisions should be to protect your kids from emotional and mental trauma.

When you put your children first and consider their feelings, you will come across as a more compassionate and loving parent to the court. And that can make a big difference in whether or not you win custody of your children.

Gather Evidence

A child custody battle is won or lost on the evidence. You want to show the court that you are the best parent for your children, and you can do that by gathering evidence to support your case.

Some of the evidence that you can use to win custody include:

  • Visitation calendar
  • Phone records
  • Records of text messages or emails between you and your ex
  • Any letters or cards sent to your children
  • Photographs of you with your children

Start gathering evidence as early as possible. The more evidence you have to support your case, the better your chances of winning custody.

Mind Your Social Media Posts

Social media may be a big part of your daily life. And you may get tempted to post about your child custody case on social media. But resist the urge to do so. Anything you post on social media can be used against you in your custody case.

Don't vent about your ex on social media. Also, mind the activities that you post about. If the court sees that you are engaging in non-child-friendly activities, it may harm your case. For example, if you post photos of yourself partying or drinking, that can be used against you in your custody case.

Cooperate With Your Ex

You may not be on good terms with your ex for obvious reasons. But try to cooperate with them during the child custody process. If you can't stand being in the same room as them, try communicating with your ex-partner via email or text messages. The important thing is to keep the lines of communication open and show the court that you can co-parent without fights.

Get Help from a Child Custody Lawyer

Navigating the child custody process can be complicated and confusing. And if you don't have any experience with family law, you may not know where to start or what to do.

A family lawyer comes in handy in this situation. First, the attorney will advise you on the best way to approach your custody case, things to do, and what to avoid during the case period. Moreover, the lawyer will help you gather evidence and prepare for court. And if your ex tries to bring you down based on your past habits or character, the lawyer will be there to defend you.
